Changes to the UK Cartel Offence – Be Careful What You Wish For

The UK Government has removed the requirement to show ‘dishonesty’ from the criminal cartel offence. In reforming the law, the Government introduced a number of new safeguards, in the form of legal exceptions and defences. Recent announcements about ongoing cases suggest that the reforms could make it more, not less, difficult to bring prosecutions.
